Herbst’s attorney added that Buffalo Bill’s will remain closed for now, but would be opened periodically for special events under the new license. He added that the main building at Whiskey Pete’s would also remain closed, but the nearby gas station and its 18 slot machines will remain open.

As part of the recommendation, board members approved several conditions, including that the approvals would expire at midnight of the June 2027 Nevada Gaming Commission meeting on the day the item is heard. The motion also required a fully executed master lease agreement be received and administratively approved by the Nevada Gaming Control Board chair or designee before gaming operations begin.

Additionally, Terrible’s will be required to file a key employee application within 60 days of issuing the gaming license, and undergo an inspection and approval of the surveillance system and/or mirrors by the board’s Enforcement Division within 60 days of issuance.

Board members urged that Terrible’s submit the settlement as quickly as attainable, so it may probably be added to a particular agenda.
