FWD.us Assertion on BIA Resolution Attacking DACA by Proscribing Advance Parole Journey

WASHINGTON, D.C. – On Thursday, the Board of Immigration Appeals (BIA) dominated in Matter of Delcarmen-Lara that journey on Advance Parole counts as a departure that triggers the three and 10-year reentry bar, overturning 14 years of settled precedent. Todd Schulte, President of FWD.us, launched the next assertion:

“This flawed determination by the BIA will impose harsh inadmissibility bars on DACA recipients who re-enter the nation after lawfully utilizing Advance Parole. We’ve seen this sample of delays, denials, detentions, and deportations designed to punish DACA recipients, and make the coverage unworkable whereas avoiding the headlines that might include asserting its termination. This is clearly an pointless, and merciless step in that very same improper path.

“Advance Parole has allowed tens of hundreds of individuals to journey with the federal government’s express permission, whether or not to sit down with a dying father or mother our damaged immigration system stored them from for years, to see a rustic they haven’t been to since they had been youngsters, or take part in coaching or enterprise journey for his or her employer.
