GAMING MACHINES ACT 1992 – SECT 67

67—Power to take away offenders

        (1)         An authorised
person, if happy that an individual who’s in a gaming area on licensed
premises—

            (a)         has
broken or bodily abused any gaming machine; or

            (b)         has
dedicated, is committing or is about to commit an offence; or

            (c)         is
behaving in an offensive, abusive or disorderly method,

might take away the individual from the licensed premises, utilizing solely such power as is
fairly mandatory for the aim.

        (2)         An individual eliminated
from licensed premises beneath subsection (1) who enters or makes an attempt to
enter the premises inside 24 hours of being so faraway from them is responsible of
an offence.

Maximum penalty: $2 500.

        (3)         An authorised
person might refuse entry to, or forestall from coming into, the gaming area, or
areas, on licensed premises any one who is behaving in an offensive,
abusive or disorderly method.

        (4)         An individual—

            (a)         who
is refused entry to, or prevented from coming into, a gaming area beneath
subsection (3); and

            (b)         who
enters or makes an attempt to enter any of the gaming areas on the premises inside 24
hours after entry is so refused or prevented,

is responsible of an offence.

Maximum penalty: $2 500.

        (4a)         The rules
might prescribe procedures to be noticed by
authorised persons in or in
reference to the prevention of individuals from coming into gaming areas.

        (4b)         An
authorised person should adjust to any procedures—

            (a)        
prescribed beneath subsection (4a); or

            (b)        
prescribed beneath the Liquor Licensing Act 1997 in relation to the elimination
by authorised persons (throughout the which means of that Act) of individuals from
licensed premises.

        (5)         The powers
exercisable beneath this part are along with another powers which are
exercisable at legislation.
